A Study on Collaborative Mechanism of Intellectual Property Administrative Law Enforcement under the Yangtze River Delta Integration Strategy

摘要长三角地区知识产权行政执法协作机制始于2003年,经过多年实践,取得了一定成绩,但仍存在诸多不足。为顺应长三角区域一体化发展战略的趋势,因应知识产权主管部门职能的变迁,考虑到知识产权侵权的特殊性,长三角地区知识产权执法协作机制可作如下完善:针对执法协作协议,可在协作条件、启动方式、争议解决、责任分担、权利救济等方面增加实质内容;对执法协作的推进,可置常设机构,将执法协作日常化;加强信息共享,及时发布预警信息;完善长三角地区知识产权行政执法协调中心、建立争端解决调解中心,鼓励设立跨区域知识产权民间机构,发挥其监督和服务职能。 The collaborative mechanism for intellectual property administrative law enforcement in the Yangtze River Delta region started in 2003.After many years of practice,it has made great achievements so far,though with quite many disadvantages.In order to comply with the trend of the integrated development strategy of the Yangtze River Delta region,and with the changes in the functions of the intellectual property authorities and the particularity of IP infringement cases,the law enforcement collaborative mechanism in the Yangtze River Delta region is supposed to get improved through the following measures:to increase substantive contents to law enforcement collaborative agreement in terms of cooperation conditions,launching methods,dispute resolution,responsibility sharing,and rights relief;to set up permanent institutions to make the law enforcement campaign as a routine for the promotion of law enforcement cooperation;to strengthen information sharing mechanism and timely release early warning information;to improve the coordination center for intellectual property administrative law enforcement in the Yangtze River Delta,establish a dispute resolution mediation center,encourage the establishment of cross-regional intellectual property institutions,and play its supervisory and service functions.
