摘要
在科技飞速发展的当代,知识产权的作用在不断凸显,对于经济的促进也愈发明显。长三角作为中国经济发展的核心区域,加强知识产权保护已经成为了一种共识,这种共识早在2009年就已达成,也取得一定的成果。但仍存在着司法审判标准不统一、行政协同保护浮于表面等问题。为此,在司法保护方面,应以建构司法裁判标准的统一为核心,设立最高法院知识产权巡回法庭或者派出法庭、建立再审案件统一管辖的审判模式、加强长三角知识产权专业审判队伍的建设;在行政保护上,应注重相关行政协议、政策的落实,明确区域行政协议的效力位阶、引入第三方监督机构、设立区域快速协调机制。
With the rapid development of technology,intellectual property plays an increasingly important role in promoting economic development.As a core region for national economic development,the Yangtze River Delta has recognized the importance of protecting intellectual property,which can date back to the year 2009.Some efforts have been made and some fruits yielded.However,some problems still exist,such as a lack of unified standards for judicial adjudication and lack of administrative protection.Therefore,it is suggested that unified standards for judicial protection should be set,such as circuit court from the Supreme Court or detached tribunal can be set up;unified management of retrial case can be organized;professional judges can be trained in the aspect of intellectual property protection.In terms of administrative protection,attention should be paid to the implementation of related administrative policies and agreements,and third-party supervision organization can be introduced and quick regional coordination mechanism should also be built.
