摘要
城镇小区配套幼儿园的产权归属是其治理工作的重点问题。在学界和司法实务界目前主要存在“业主共有说”“政府所有说”和“开发商所有说”三种观点。经由学理解释、实践分析得出“业主共有说”难以立足;以土地使用权取得方式为划分标准对“政府所有说”和“开发商所有说”进行分类讨论有一定合理性,但也存在分类过于笼统,难以应对实践中复杂产权状况的局限性。为弥补上述缺陷,需构建一套“强行性规则先行、有约定从约定、无约定坚持公平原则和公益性原则”的城镇小区配套幼儿园产权认定规则体系。
The property attribution of supporting kindergarten in urban residential estate constitutes a critical issue in its governance.Different theories have been developed in academia and legal practice,such as“jointownership to all proprietors”,“ownership to government”,and“ownership to estate developer”.The“jointownership to all proprietors”theory can hardly survive doctrinal explanation and practice analysis.To some extent,it is reasonable to categorize and discuss“ownership to government”and“ownership to estate developer”based on classification standard on how to acquire ownership of land.However,this approach is also limited,either due to ambiguous categorization,or to complicated ownership status in practice.Therefore,it is necessary to develop a system of triple-level rules.Firstly,make mandatory rule as the priority.Secondly,follow the pre-existing agreement.Thirdly,respect equality and publicity principle in case of no pre-existing agreement.The system could be applied to attribute property of supporting kindergarten in urban residential estate.
