摘要
我国建筑物区分所有权制度的发展历程是理性主义和经验主义对立与融合的过程。"区分所有"概念的引入、"物业管理"制度的借鉴和发展,共同构成了我国《物权法》第六章"业主的建筑物区分所有权"的基础。基于"摸着石头过河"的立法思想和"两步走"的立法策略,我国建筑物区分所有权制度的构建未经充分的理性论证,大量依循既有住房政策和法规,并延续了住房公有时期的管制思维,使得《物权法》第六章相对空洞而难以操作,其作用被更具实用性的司法解释和物业管理法规所取代。在民法典编纂结束之际,仍有必要反思经验主义立法的消极影响,重申"业主自治"和"团体主义"的立法理念,合理吸收域内外有益经验和制度,合理使用配套规则、司法解释等方式科学地构建我国的建筑物区分所有权体系。
The development process of the condominium ownership of building in China is a process of the opposition and integration of rationalism and empiricism.The introduction of the concept of separate ownership and the reference and development of the system of property management constitute the basis of chapter six of the owner’s separate ownership of buildings in the Property Law of China.Because of the legislative thought based on"touching the stones while crossing the river"and"two-step"legislative policy,the construction of China’s building divisional ownership system has not been fully rationalized,and a large number of existing housing policies and regulations have been followed,and the regulatory thinking of the housing public period has been continued,making ChapterⅥof the Property Lawrelatively hollow and difficult to operate.The role of the Property Law has been replaced by more practical judicial interpretation and property management regulations.Although the compilation of civil code is finished,it is still necessary to reflect on the negative impact of empirical legislation,reaffirm the concepts of"owner autonomy"and"collectivism",and absorb the beneficial experience all over the world and scientifically construct the system of building differentiated ownership in China by means of rational use of supporting rules and judicial interpretation.
