摘要
野生动物群体有可能引发人类重大公共卫生风险,这一确证足以让我们重新思考人与野生动物之间关系,重新检视当前野生动物保护法律体系的妥适性。从完善《野生动物保护法》及配套措施、关联立法、地方立法、紧急性立法四个方面检视目前我国野生动物保护法律体系,其于立法目的、立法内容、立法配套等方面仍存在许多问题。借鉴国际先进经验,我国野生动物保护法律体系应重塑野生动物保护法律体系的理念构造,全面修正野生动物保护法的规范内容,及时更新野生动物保护法相关配套措施,系统修订野生动物保护关联立法,优化野生动物保护地方立法。
Wildlife groups may cause major public health risks for human beings.This confirmation is enough for us to rethink the relationship between human beings and wildlife and reexamine the appropriateness of the current legal system for wildlife protection.This paper examines the current legal system of wildlife protection in China from four aspects:improving the wildlife protection law and supporting measures,related legislation,local legislation and emergency legislation.There are still many problems in its legislative purpose,content and supporting legislation.Based on the international advanced experience,China’s wildlife protection legal system should reshape the concept of the wildlife protection legal system,comprehensively amend the normative content of the wildlife protection law,timely update the relevant supporting measures of the wildlife protection law,systematically revise the related legislation of wildlife protection,and optimize the local legislation of wildlife protection.
