摘要
从性质来看,扫黑除恶专项斗争是一项法治工作,而且主要涉及到刑事法律的司法适用。国家意欲依托刑法的工具价值,通过刑法早期介入,达到预防并治理黑恶势力犯罪带来的风险,维护社会稳定和增强人民安全感的终极目标。刑法过度介入扫黑除恶的进程,也带来了一些困境:为了安全价值而弱化或放弃法治原则,出现了介入时间提前、介入范围扩大和刑罚适用从严等现实难题。基于此,应当客观分析扫黑除恶进程中刑法介入的现状,结合相关案例,分析现实难题与原因,借助预防理念、行刑衔接和打准打实等多种途径,完善刑法介入扫黑除恶的限度,以期为有效治理黑恶势力违法犯罪提供建议,推动扫黑除恶专项斗争向纵深发展。
Basically,the special fight against crime crackdown is a work of regulation and law,and mainly involves the judicial application of criminal law.Relying on the instrumental value of criminal law,the state intends to achieve the ultimate goal of preventing and controlling the risks brought by crimes committed,maintaining social stability and enhancing people's sense of security through early intervention of criminal law.However,the excessive involvement of criminal law in the process of crime crackdown also brings some dilemmas:We have no choice but weaken or even abandon the principle of rule of law for the sake of safety value,which leads to heavy problems like intervening time in advance,magnifying scope of intervention and constraining application of penalty.In order to solve the above-mentioned problems,on the one hand,we ought to objectively make an analysis about the current situation of criminal law intervention in the process of crime crackdown,making a combination with corresponding cases,which contributes to make the practical problems and causes clearly.On the other hand,with the help of prevention conception,the connection of action and criminal law,fatal crackdown and so on,we should improve the limits of criminal law intervention in crime crackdown for the purpose of providing suggestions for effective control of illegal crimes committed by criminals and therefore promoting the development of special fight against crime crackdown.
