摘要
虐童行为不仅损伤学前儿童心理机能,而且危害学前儿童大脑生理机能,容易引发生理疾病、心理失衡、学业不良、人格障碍等诸多问题,对其未来成长造成极大危害。鉴于虐童行为的危害后果,以及已有法律在虐童行为治理上存在的不足,学前教育立法必须明确虐童行为法律责任。为了明确虐童行为法律责任,学前教育立法必须明确虐童行为的构成要件,制定专门针对虐童行为的法律责任条款。学前教育立法中虐童行为具体法律责任包括:行政责任、民事责任、刑事责任。
Child abuse not only damages the psychological function of preschool children,but also harms the brain physiological function of preschool children. It is easy to cause many problems such as physiological diseases,psychological imbalance,academic problems,personality disorders and so on,which will cause great harm to their future life. In view of the harmful consequences of child abuse and the shortcomings of existing laws in the governance of child abuse,the legislation of preschool education must clarify the legal responsibility for child abuse. In order to clarify the legal responsibility for child abuse,the legislation of preschool education must clarify the constitutive elements of child abuse,and establish specific legal liability for child abuse. In the legislation of preschool education,the specific legal liability of child abuse includes: administrative liability,civil liability and criminal liability.
