摘要
在建设中国特色社会主义法律体系,加强重要领域立法,以良法保障善治的新时代背景下,继续教育立法彰显着提升继续教育社会地位、保障公民学习权以及助推终身教育体系构建的价值意蕴,并在实践中取得一定进展,为继续教育的发展提供了法律保障,但同时也存在着单行法律缺失、法律效力层次低、可操作性不强和理论研究不足的实践困境。应采取制定继续教育根本大法、完善继续教育法律规范体系、注重立法精细化和深化理论研究的有效路径,以促进我国继续教育立法进程的不断深化。
In the new era of building the socialist legal system with Chinese characteristics,strengthening legislation in important areas,and safeguarding good governance with good laws,continuing education legislation highlights the value implications of enhancing the social status of continuing education,protecting the right to learn,and helping to build a lifelong education system.Some progress has been made in practice to provide legal guarantees for the development of continuing education,however at the same time,there are also practical dilemmas,such as the lack of separate laws,low level of legal effect,poor operability,and insufficient theoretical research.We should take the effective path to formulate the basic law of continuing education,improve the legal system of continuing education,pay attention to legislation refinement and deepen theoretical research in order to promote the continuous deepening of the continuing education legislation process in China.
