摘要
“依法治体”是“依法治国”在体育市场监管层面的延伸与表现。随着上海体育赛事的日益增长,体育市场监管的法制化具有现实意义与可行性。分别从监管主体的自治性、监管方式的合法性以及监管理念的法制化三个层面对上海体育市场监管的法律价值作出分析。在具体措施方面,从监管的范围、监管的水平与监管的环节三方面对现有体育市场存在的问题展开剖析。立足于上海建设“国际体育赛事之都”的大背景,在梳理现有法律法规、规范性文件的基础上,提出相应立法与修法建议,率先实现上海体育市场监管的法制化,最终推动我国体育市场监管的法制化进程的深入。
“Governing sports by law”is the extension and reflection of“rule by law”in sports market supervision.With the increasing of sports events in Shanghai,the legalization of sports market supervision is of the practical significance and feasibility.This research analyzes the legal value of Shanghai sports market supervision from three aspects:the autonomy of the supervision subject,the legitimacy of the supervision method and the legalization of the supervision concept.In terms of specific measures,the problems existing in the sports market from three aspects are analyzed:the scope,level and method of supervision.On the background of constructing“international sports events capital”in Shanghai,after reorganizing the existing laws,regulations and legislative documents,the research puts forward corresponding legislation and modification suggestions,takes the lead in realizing the legalization of Shanghai sports market supervision,and finally promotes the legalization of national sports market supervision.
