摘要
农村法治现代化建设是当代中国法治发展的重要组成部分,实现农村治理的法治化关系到法治中国梦的实现。目前,经济发展滞缓、农民法治意识淡薄、农村法治建设的法律体系不完善以及农村法治文化落后等诸多因素严重阻碍中国农村法治建设现代化的步伐。化解农村法治现实困境的有效方案必须以法治化的实践方式着力推动农村法治建设稳步实施,包括完善立法保障农村基层法治推进,增强农民参与治理的权利意识,推广公益律师参与乡村维权制度,践行农村法治、德治与基层自治共进的治理模式,强化党和政府对于法治农村建设的领导力和向心力。
The modernization of the rule of law in rural areas is an important part of the development of contemporary rule of law in China.The realization of the rule of law in rural governance concerns the realization of the Chinese dream of rule of law.At present,many factors,such as sluggish economic development,weak awareness of rule of law among farmers,the incomplete legal system of rural rule of law construction,and backward culture of rule of law in rural areas,have seriously impeded the pace of modernization of rule of law in rural China.The effective scheme to resolve the practical predicament of the rule of law in rural areas must promote the steady implementation of the construction of the rule of law in rural areas by the practice of rule of law.This includes improving legislation to ensure the promotion of the rule of law at the grass-roots level in rural areas,enhancing the awareness of farmers'rights to participate in governance,extending the participation of public interest lawyers in the rural rights protection system,implementing the governance model of rule of law,rule of virtue,and grass-roots autonomy in rural areas,and strengthening the leadership and centripetal force of the party and government for the construction of rural areas under the rule of law.
