摘要
安全地带制度是沿海国用以保护人工岛屿等海上构筑物的一项特殊制度。沿海国有权根据《联合国海洋法公约》的规定设立安全地带,并在安全地带及附近范围内享有禁航、识别、紧追、登临等相关权利。在南海海域,此制度在对抗美国“航行自由”活动上相较于内水、领海制度更具有理论优势。实践中可通过官方正式主张、针对南海人工设施设立安全地带、加强人工设施的建设以及对美国实施对等行为等措施,对抗美国“航行自由”活动。
The safety zone is a special system used by coastal states to protect offshore structures such as artificial islands. The coastal state has the right to establish a safety zone in accordance with the provisions of the United Nations Convention on the Law of the Sea, and the coastal state has the right to take appropriate measures in the vicinity of safety zones, such as to prohibit the navigation,to identify all ships,to exercise the right of hot pursuit and the right of visit. In the South China Sea, compared with the system of the internal waters and territorial waters, the safety zone system has the theoretical advantage in opposing the "Freedom of Navigation" of the United States. In practice, we can confront the "Freedom of Navigation" of the United States through the official claim, establishing safety zones for various artificial structures in the South China Sea, strengthening the construction of artificial structures or implementing reciprocal actions against the U.S.
