摘要
吸毒行为具有一定的社会危害性,经过强制戒毒后的复吸行为其人身危险性、社会危害性则更加严重。对于初次吸毒人员,应当着重考虑其病人身份,以教育救助为主,采取社区戒毒、强制戒毒等行政手段进行警告、救助。然而,对复吸人员仅通过行政措施进行救助、警告,难以起到理想的效果,因此需要增加打击力度。通过复吸入刑的举措,不仅可以打击复吸行为、警示吸毒人员,还可以倒逼复吸人员供出幕后毒品的提供者,进而全方面地打击售毒、贩毒行为。为此,应当对复吸行为采取刑法手段予以打击,其具体方式为:将强制戒毒作为执行刑罚前的前置治疗手段,在强制戒毒后,综合考虑其复吸的情节,对于复吸行为采取刑法手段进行打击。
Drug-taking behavior has certain social harmfulness,and the re-addicts after compulsory detoxification have more serious personal danger and social harmfulness.For those who take drugs for the first time,their patient status should be taken into consideration.Education and assistance should be given priority to,and administrative measures such as community detoxification and compulsory detoxification should be taken for warning and assistance.However,it is difficult to achieve the desired effect only through administrative measures to rescue and warn those who relapse,so it is necessary to increase the crackdown.The measures of criminal law for the re-addicted not only can strike their behaviors and warn drug addicts,but also can force the re-addicts to betray the drug providers,and then combat the sale and trafficking of drugs.Therefore,criminal law should be adopted to crack down on the re-addicts.The specific ways are as follows:compulsory detoxification should be taken as a pre-treatment method before execution of punishment,and after compulsory detoxification,criminal law should be adopted to crack down on the re-addicts’behaviors after comprehensive consideration of re-addicting situations.
