摘要重大改革于法有据,首先要求重大改革于宪法有据。当下全面深化公安改革进入到攻坚期和深水区,亟需宪法来规范、引领、推动、保障改革,以破除改革阻力、形成改革合力、化解改革风险,确保改革在法治轨道上平稳有序推进。对《关于全面深化公安改革若干重大问题的框架意见》及相关改革方案和措施进行合宪性检视,不难发现其关涉的重点是警察权的公安内部运行及规制问题,而较少关切到作为警察权运行和规制之前提的宪法框架下的警察权配置问题。全面深化公安改革的有效推进,必须遵循宪法基本原则,将警察权的配置问题置于宪法总体框架下进行妥善考量和合理勾画,并在宪法指引下系统地完善以《人民警察法》为核心的警察法体系。 Major reforms should be based on law, the first thing is that major reforms should be based on Constitution. At present, the comprehensive deepening of public security reform has entered a critical period and a deep water area in China, relevant reforms need to be regulated, guided, promoted and guaranteed through the Constitution, so as to break the resistance, form the resultant force of reform, defuse the risk of reform, and ensure its smooth and orderly progress on the track of the rule of law. Through the constitution review of " Framework Opinions on Several Major Issues of Comprehensively Deepening Public Security Reform" and related reform programs and measures which have been issued by CPC Central Committee, it is not difficult to find that the focus has always been on the internal operation and regulation of police power, but less attention has been paid on the issue of police power allocation under the constitutional framework which is a precondition of the operation and regulation of police power. Therefore, we should follow the basic principles of the Constitution, and put the issue of police power allocation into the constitutional framework that require appropriate consideration and rational planning, at the same time, we also should improve the law system of police systematically with "People`s Police Law of the PRC" as the core under the guidance of the Constitution.
