摘要
环境问责作为环境治理的重要保障措施,在实践和理论上日益受到中央和地方政府的重视,尤其在水环境治理方面。环境问责在河(湖)长制中体现的是一种考核问责机制,作为推行河(湖)长制的保障措施,有其必要性。国家和地方关于河(湖)长制问责的规范不尽相同,但均未明确问责的具体措施。分析各地方规范暴露出河(湖)长制问责仍存在问题:考核机制不合理、问责机制不健全、公众参与缺位。出现问题的关键在于河(湖)长制的“非法定性”,应当通过法治化和规范化完善考核问责,以推动河(湖)长制从全面建立到全面见效。
Environmental accountability is an important safeguard for environmental governance. It's increasingly valued by the central and local governments in practice and theory, especially in water environment management. Environmental accountability is reflected in the river (lake) chief system is an assessment accountability mechanism. It's necessary as a safeguard for the implementation of the river (lake) chief system. National and local norms on accountability of river (lake) chief system aren't the same and lack specific accountability measures. There are still problems exposed to the river (lake) chief accountability in the local norms: the assessment mechanism is unreasonable, the accountability mechanism is imperfect, and public participation is absent. The key factor is the"illegal qualitative"of the river (lake) chief system. The assessment and accountability should be improved through legalization and normalize, so as to promote the river (lake) chief system from comprehensive establishment to full effect.
