摘要
知识产权法院的设立是我国司法体制的重大改革,既与加强知识产权司法保护的国际趋势和国内需求有关,也是十八大以来司法改革的重大突破,应当立足于当代中国司法改革的总体布局深刻地理解建立知识产权法院的必要性、可行性和目的。目前,北京、上海、广州知识产权法院已按照司法改革的要求,建立了新型的审判权力运行机制,需要进一步总结经验,逐渐建立完善的知识产权法院体系,并深入推进民事、行政和刑事诉讼的"三合一"改革,在此基础上探索诉讼与行政复议的程序衔接,最终运用新型审判机制有效解决知识产权纠纷涉及的不同诉讼问题。
The establishment of intellectual property court is a major reform of China’s judicial system, which is not only related to the international trend and domestic demand for strengthening the judicial protection of intellectual property right, but also a major breakthrough in judicial reform since the 18th National Congress of the Communist Party of China. It is important to deeply understand the necessity, feasibility and purpose in establishing intellectual property court based on the overall layout of judicial reform in contemporary China. At present, the intellectual property courts in Beijing, Shanghai and Guangzhou have established a new judicial power operation mechanism in accordance with the requirements of judicial reform. It is necessary to further summarize experiences and gradually establish a sound intellectual property court system. Besides, the “three trials in one” reform, by which the civil, administrative and criminal trials are uniformly performed, should be profoundly promoted, and explore the connection between litigation and administrative review procedures. The ultimate goal is to use the new judicial mechanism to uniformly solve various litigation problems concerning intellectual property disputes.
