摘要
行政诉讼一并审理民事争议制度作为实质性解决行民交叉案件的重要制度设计,对于优化行政诉讼格局、促进国家治理体系和治理能力现代化,具有重要价值。然而,该制度在实践中仍然处于"休眠状态",制度设计的初衷并未有效实现。故应以激活一并审理民事争议制度为导向,多维度地实证分析制度适用的难点和堵点,在进一步明晰内在规律、构建原则和制度特色的基础上,从适用范围、立案申请及审查程序、审理与裁判程序、相关配套举措等方面提出具体可行的建议。
Settlement of the relevant civil dispute concurrently in an administrative procedure is a great system arrangement for the substantive settlement of administrative and civil cross disputes,which is of important value for optimizing the administrative procedure pattern and promoting the modernization of the national governance system and governance capacity.In practice,however,the system is still in a“dormant state”,and the original intention of the system design has not been effectively realized.Therefore,guided by the purpose of activating the system,this article applies multiple empirical analysis methods to analyze the difficulties in the practice of the systems,and further discriminate the inherent institutional characteristics,the internal law and the principle in system construction of the concurrent settlement of the relevant civil dispute in an administrative procedure.On the basis of the above analysis,this article has proposed specific improvement suggestions and strategic approaches on the scope of application of the system,the application and review procedures,the trial and judgment procedures and related supporting measures with a expect to forming a system operation framework that conforms to the current judicial practice.
