摘要
论文从俄罗斯海外同胞权益保护的法律根据、俄罗斯海外同胞权益保护制度的主要内容、俄罗斯海外同胞权益保护制度的特点三个方面,分析研究了俄罗斯海外同胞权益保护的理论与实践,旨在为我国侨务法治建设提供一些经验借鉴。研究显示,俄罗斯重视海外同胞权益保护立法,构建了比较完善的法律体系;其相关立法既有专门法律法规和行政命令,也有散见于各部门法的有关规定,内容涉及国籍制度以及政治、经济、文化权利保护等;俄罗斯通过专门立法、实行有限双重国籍制度,为海外同胞权益保护奠定法律基础,并且取得显著成效。
This paper explores the theory and practice of protecting the rights and interests of overseas compatriots in Russia.It analyzes the legal basis,the main content and the characteristics of the protection system of Russian overseas compatriots'rights and interests,aiming to provide some experience for the legal construction of overseas Chinese affairs.The studies shows that Russia attaches great importance to legislation on the protection of the rights and interests of overseas compatriots,and has established a relatively complete legal system.The relevant legislation in Russia includes special laws,regulations and executive orders,as well as relevant provisions scattered in various department laws.The content covers the nationality system and the protection of political,economic and cultural rights.Through special legislation and limited dual nationality system,Russia has laid a legal foundation for the protection of the rights and interests of overseas compatriots and achieved remarkable results.
