摘要
针对我国当下社会的热点问题——未成年人监护,论述了委托监护尚未纳入我国民事基本法中,且现有立法规定过于粗疏,导致其未能充分发挥实际功能,在面临留守儿童问题时略显无力的现状。通过对相关立法例进行比较研究认为,委托监护系未成年人监护制度的重要补足,应在理清委托监护性质及适用条件、明晰委托合同相关事项、明确监护人与受托人责任承担,以及建立监护监督等方面探索未成年人委托监护制度的完善路径,从而更好地保障未成年人合法权益,促进未成年人健康成长。
The guardianship of minors is a hot issue in present China.The legal guardianship system of minors appears weak in the face of the problem of the left-behind children,making the minors entrusted guardianship system an important supplement.However,the minors entrusted guardianship system has not been included in the basic civil law yet,and the existing legislative provisions are too inadequate now,resulting in a major malfunction of the system above.Through comparative research on relevant legislation,it is believed that the entrusted guardianship system is an important complement to the minor s guardianship system,which should clarify the nature of the entrusted guardianship and applicable conditions,clarify matters related to the entrusted contract,and clarify the responsibility of the guardian and the trustee,and establish a monitoring and supervision system to explore the perfect path of the entrusted guardianship system for minors,so as to better protect the legitimate rights and interests of minors and promote the healthy growth of minors.
