摘要
在人权保护特殊的发展轨迹中,有些部分是决策者或行动者基于明晰的理念主观推动的结果,但相当多的部分则是在繁杂的主客观互动中非刻意产生的。受刑人权利长久以来并未得到学界广泛的重视与分析,但在人权道路的持续发展进程中已然形成一系列综合性特点。本文以精神障碍受刑人、未成年受刑人以及女性受刑人三类弱势群体权利保护为例探讨受刑人权利保护的针对性、预防性及均衡性特点。受刑人权利保护不仅止于以上提到的三点特征,只希望从以上三个切入点入手,能够进一步经验性地考察受刑人权利保护的脉络性规律,以求窥一斑而见全豹。
Some parts of human rights'protection are based on potentate's ideas and aspirations,but quite a lot of parts are in a complicated interaction between objective and subjective.Prisoners'rights did not get wide attention and analysis in past time,but the rights'protection has formed a series of comprehensive characteristics in practice.The paper will take mental disorder prisoners,underage prisoners and female prisoners for example to explore the pertinence,prevent ability and proportionality in prisoners'rights protection.The characteristics of prisoners'rights protection definitely are not limited to the three features mentioned above,and just wish doing further studies according to the logical rule and to establish a whole scenery.
