On the Conversion of the Criminal Evidence into the Administrative Evidence

摘要 2012年新《刑事诉讼法》中规定了行政证据可以转化为刑事证据使用,为行政证据转化为刑事证据提供了法律支持。但刑事证据是否可以转化为行政证据使用,如何转换?在翻阅大量行政法律法规后发现,刑事证据转化为行政证据存在严重的立法缺失,仅有公安部出台的《公安机关办理行政案件程序规定》容许在公安机关内部办理刑事转行政案件的中使用。刑事证据转化为行政证据决定着刑事转行政案件的办案质量,具有重大意义,不容忽视。从刑事证据与行政证据两种证据的相同点和不同点两个角度分析,寻求刑事证据转化为行政证据的合理性。之后,根据两种证据的相似点及不同点构建了直接转化、经法定程序转化、不能转化三种转化模式,旨在为刑事转行政案件的证据衔接转化提供一定思路。 The new Criminal Procedure Law in 2012 stipulates that the administrative evidence can be converted into the criminal evidence, providing legal support for the conversion of the administrative evidence into the criminal evidence. However, can the criminal evidence be transformed into the administrative evidence and how？ After reviewing a large number of administrative laws and regulations, it is found that there are serious legislative defects when transforming the criminal evidence into the administrative evidence. Only Regulation for Procedures of Administration Cases by Public Security Organs put by Ministry of Public Security allows the use of the criminal evidence in handling administrative cases which are transferred from criminal cases within public security organs. Transforming the criminal evidence into the administrative evidence determines the quality of administrative cases transferred from criminal cases, which is of great significance and cannot be ignored. Analyzing from similarities and differences between the criminal evidence and the administrative evidence, this paper seeks the rationality of transforming the criminal evidence into the administrative evidence. After that, three modes of transformation, direct transformation, transformation by legal procedure, and non-transformation, are constructed according to similarities and differences between these two kinds of evidence, which aims to provide some ideas for the convergence and transformation of evidence in criminal to administrative cases.
