摘要为了实现国家监察全面覆盖,监察委员会就要对所有行使公权力的公职人员进行监察。由于民主集中制原则,监察委员会不能够对同级人民代表大会及其常务委员会进行监察。监察委员会监察之对象应为人员而非机构。按照《监察法》第3条和第15条的规定,监察委员会是能够监察人大代表的。从域外的情况看,按照议会自律原则的理论,监察机关一般不将代议机关的议员纳入监察对象之范围;但是由于我国实行人大代表制度,如果将中国五级三百万人大代表排除在监察对象之范围外,将会使监察对象之范围出现一个很大的缺口,与实现国家监察全面覆盖的立法意旨不相符。从中国国情来看,监察委员会应当能够监察人大代表。监察委员会在监察人大代表时存在着监察职责、监察措施、监察程序三方面的限度。 In order to achieve full coverage of national supervision,the supervisory committee must supervise all public officials who exercise public power. Because of the principle of democratic centralism,the supervisory committee cannot supervise the people ＇s congress and its standing committee. The object of the supervision committee should be personnel rather than institutions. In accordance with the provisions of the third and fifteenth provisions of the supervisory law,the supervisory committee is able to supervise the representatives of the people＇s congress. Although,according to the theory of parliamentary self-discipline,overseas supervisory organs do not include members of the representative organs in the scope of supervision.But because China implements the part-time system of the representatives of the people＇s congress,if the representatives of China＇s five level people＇s congress are excluded from the scope of the supervision object,the scope of the supervision object will appear a big gap,which is not consistent with the legislative intention of realizing the comprehensive coverage of the state supervision. From the perspective of China ＇s national conditions,the supervisory committee can also supervise the representatives of the people＇s congress. When supervising the representatives of the people ＇s congress,the supervisory committee has three limitations：supervisory duties,supervisory measures and supervisory procedures.
