摘要
本文旨在梳理和探讨东盟推动"南海行为准则"的历程和动因,研判其前景。为稳定南海地区局势,东盟致力于打造一份具备法律约束力的"南海行为准则",这是冷战结束至今东盟在南海问题上的原则性目标。为此,从20世纪90年代初期开始倡导针对南海问题的"行为准则",到2018年开启"南海行为准则"文本的实质性谈判,东盟寻求制定"南海行为准则"的努力持续近30年,基本上贯穿了冷战后南海问题及东盟与中国关系起伏动荡的历程,可谓审视南海问题的一条关键线索。在这一过程中,东盟也不得不作出必要的妥协——这不仅体现了东盟的务实,也折射出东盟的无奈。东盟向其成员国在对华政策和南海问题上的分歧妥协,向中国主张低版本"南海行为准则"的稳健策略妥协,还不得不向谈判进程中南海地缘格局发生极大改变的现实妥协。东盟积极倡导的"南海行为准则",契合了美国等域外大国在南海问题上以"规则"抑制中国的目标,这一方面成为东盟推动"南海行为准则"谈判的最大动力,另一方面也是东盟无法达成具备法律约束力的"南海行为准则"的最大障碍。
This article aims to study ASEAN's contributions for the negotiation of a Code of Conduct for the South China Sea( Co C). ASEAN wants to regulate the issues for the South China Sea by rules,so it has worked hard to finish the Co C with China after the cold war. Unfortunately,ASEAN's efforts for the Co C have not resulted in a positive one. Due to the importance of the South China Sea for ASEAN and its members,ASEAN will continue its work for the Co C. ASEAN has been more active in pushing the negotiation for the Co C than China who usually questions ASEAN's motive for Co C.ASEAN will not give up its aim on the Co C while ASEAN has to give in some aspects of the requirements for the Co C from some of its members. Although the prospect for Co C will not meet ASEAN's need,ASEAN's contributions for Co C should not be neglected.
