摘要
《排污许可管理条例》的内容应包括排污许可的实施机关、条件、程序、期限等各个方面。其中,应重点关注与排污单位权利义务、政府部门权责配置、各主体法律责任等相关的事项,如排污许可的法律性质、适用范围、实施主体、实施程序、法律责任等。对于实施排污许可所涉及的技术性问题,如标准、名录、技术规范等,可通过条例授权生态环境部门进行规定。在《排污许可管理条例》制定完成之后,应及时对《排污许可管理办法(试行)》进行全面修订。
The content of the Pollutant Discharge Permit Management Regulations shall include all aspects of the pollutant discharge permit,such as implementation agencies,conditions,procedures,and deadlines. Among them,attention should be paid to matters relating to the rights and obligations of pollutant discharge units,the responsibility allocation of government departments,and the legal liability of all parties,such as the legal nature of the pollutant discharge permit,scope of application,implementing agencies,implementation procedures,and legal liability. The technical issues involved in the implementation of the pollutant discharge permit,such as standards,lists,technical specifications,can be regulated by the ecological environment department via authorization of the regulations. After the formulation of Pollutant Discharge Permit Management Regulations,the Management Methods for the Pollutant Discharge Permit（ Trial）shall be revised in a timely manner.
