摘要
讨论经典阅读对法学教育的意义可聚焦于以法治为主题而展开相关的话语与商谈建构。在当代法学视域中，诸如自然法学的经典理论为现代法治意识、法治理念和原则的巩固与传播积淀了诸多值得宣扬的叙述。从中国当下现实来看，德性法制的发展和现代法治的构建确需包括自然法理论在内的经典理论对当下法律实践和法学教育的持续性支持与浸润。中国法学教育要综合地揭示和传授有关法律或法治的全部图景。经典理论的研读无疑可以给法科学生带来不同理论范式和语境脉络下的有关法律秩序的认知。
The discussion of the significance of classics reading to legal education may focus on the theme of rule of law and its related discourse and conversation. In the field of contemporary jurisprudence, classical theories, such as natural law, have consolidated and propagated modem sense of rule of law ,the concept and principles of rule of law, so that they are worthy of publicity with a number of meaningful legal stories. From the perspective of China＇s current situation, the development of virtuous legal system and the construction of modem rule of law substantively require continuous support from the classical theory and infiltration of the classical theory, including natural law theory, to contemporary legal practice and legal education. China＇s legal education should comprehensively reveal the full picture of rule of law and relevant laws. The study of the classical theory will no doubt provide law students with different theoretical paradigms and contextual cognition of legal order.
