摘要
司法诚信理念在认罪认罚从宽制度的构建中具有重大作用。在认罪认罚从宽制度中秉持司法诚信具有正当性基础：司法诚信是合意的源泉,是公正与效率价值的平衡,是司法伦理的精髓和程序法定的灵魂,也是证明标准下降的保障。从启动、协商、审查、确认、效力各个环节中,认罪认罚从宽制度构建中体现了司法诚信精神,也面临着可能性障碍及其克服。
The concept of judicial integrity has a great guiding role in the construction of the leniency system of confession and punishment. Judicial integrity has a justifiable foundation for the construction of the leniency system of confession and punishment,that is,judicial integrity is the source of consensus,the balance of justice and efficiency,the essence of judicial ethics,the soul of procedure legality and the guarantee of lowering the standard of proof. From the aspects of initiation,consultation,investigation,confirmation and effectiveness,the establishment of the leniency system of confession and punishment reflects the spirit of judicial integrity,and also faces possible obstacles and overcomes them.
