摘要
《严格排除非法证据规定》细化、扩充了刑讯逼供等非法方法,初步确立重复性供述排除规则,对重大程序性违法获取的供述如何处理予以明确。与此同时,《严格排除非法证据规定》对非法证据排除的程序问题予以完善,一些规定具有突破意义。《严格排除非法证据规定》存在一些不足之处,主要是实体性规则存在不足,对一些争议问题没有规定,一些规定仍然较为模糊,实践中可能会存在争议。《严格排除非法证据规定》的修订是有必要的,具有重要意义。未来修订规则时,应当反思规则修订的具体方法。
The Provisions on Several Issues concerning the Strict Exclusion of Illegal Evidence in Criminal Cases refines and enriches illegal ways of obtaining evidence including extorting confessions by torture. It preliminarily establishes the exclusionary rule of repeated confessions and clarifies how to deal with confessions obtained through significant procedural illegality. Meanwhile, it improves the procedure of exclusion of the illegal evidence and some of its provisions are groundbreaking. It has, nevertheless, some imperfections in substantive rules as it does not clarify some controversial problems; also, some rules are vaguely described, which may provoke controversies in practice. Therefore, it is necessary and significant to revise it and contemplate on the specific revision methods.
