摘要
公平是社会保险制度的价值目标和法理基础,可持续是社会保险法的基本原则。目前我国的社会保险制度在公平性和可持续性方面还存在着覆盖面不足、制度碎片化、社会保险基金难以持续、多支柱社会保险发展不够均衡、新型社会风险应对不充分等问题。为建立更加公平和可持续的社会保险制度,应当从如下几方面着力:第一,进一步构建全民参保的法律制度;第二,重视顶层设计和体系构建,整合社会保险制度,突破碎片化瓶颈;第三,按照精算平衡的保险原则,完善社会保险基金法律制度;第四,按照"保基本""多层次"的原则,完善多支柱的社会互助保障体系;第五,探索制度创新,妥善应对社会转型中新增的社会风险。
Equity is the value objective and legal theoretical basis of social insurance system,and sustainability is one of the legal principles of social insurance law.Currently China＇s social insurance system still exits deficiencies in terms of equity and sustainability in insufficient coverage,system fragmentation,unsustainable social insurance fund,lack of response to the new socialrisksandsoon.Inordertoestablishamore equitable and sustainable social insurance system,it should be carried out from the following aspects：first,to make further efforts to construct the social insurance of universal coverage;second,to pay more attention to the top-level design and system construction of the social insurance system to solve the problem of fragmentation;third,to perfect the legal system of the social insurance fund according to the insurance principle of accuracy and balance;fourth,to improve the multi-pillar social insurance system in accordance with the principles of basic security and multiple level;fifth,to explore the system innovation to properly cope with the new social risks in the social transformation.
