摘要
单位作为参与社会、经济活动的重要主体,对其规制的制裁正义也尤为重要。我国法律格局经历了诸法合体到部门法分立,形成了对单位违法犯罪行为的民事法、行政法、刑事法三部门的制裁体系。然而,这种部门化制裁在立法上和司法实践中却存在着制裁外溢与法律属性的矛盾、严厉性与法律效果的失衡、制裁竞合与法律适用的混乱、认定标准与法律救济的失当等碎片化问题。从顺应公法与私法分立下融合的趋势出发,妥当把握私法公法化与公法私法化的限度,我国单位主体制裁碎片化修复的具体路径可以从建构一体化的单位主体制裁体系、明确单位主体制裁在不同程序中的竞合适用、提升单位主体制裁的认定标准、促进单位主体制裁与非制裁性法律责任的联动等方面着手。
Unit has become a more and more important subject in the activities of social and economic areas,sanctions of which are also of great significance to achieve the regulation justice. The pattern of our law has experienced from combination of all laws to division of branch law,and forms three sanction systems including civil law,administrative law,and criminal law for unit＇s illegal and criminal acts. However,this kind of departmentalization of sanctions causes a series of fragmentation problems in the legislation and judicial practice,such as the contradictions between sanctions spillover in civil law and legal attribute in public-private law,the imbalance in the severity and legal effect of sanction,the chaos in applying laws when sanctions in different laws coincide,and the impropriety in the judging standards and legal remedy. To keep up with the fusion trend of public law and private law under the separation background, and to grasp the limit of overlapping of public law and private law properly,we can take measures to repair the said fragmentation：firstly,construct integration system of unit sanctions; secondly,make unit sanctions in the concurrence of different application clear; thirdly,increase the judging standards of unit sanctions; and finally,promote the linkage between the unit sanctions and the non-punitive sanctions.
