摘要
分析近几年个人身份信息被盗用典型案件及其对受害者在经济、精神及信用方面的损害,探讨信息主体信用情况修复困难或无法修复的内在原因。为加强身份盗用信息主体信用修复机制建设,应完善法律法规,明确身份盗用案件受理的主管部门;加强对身份盗用的执法力度;利用网络平台,增设"身份盗用修复服务"模块或开发手机APP软件;完善不良信用信息修复渠道,提升信息主体维权意识;推动身份盗用类保险产品的发展。
Based on an analysis on the typical cases of personal identity theft and its economic,psychological and credit damages to victims in recent years,the paper discusses the internal causes why the information subjects’ credit recovery is difficult or impossible. In order to strengthen the construction of credit recovery mechanism for identity theft,we should improve laws and regulations,make clear the department in charge of identity theft case acceptance; focus on the enforceability for identity theft; add an "identity theft reparation service " module or develop APP mobile phone software by using a network platform; improve the reparation channels of bad credit information, enhance information subjects ’ awareness of protecting interests and rights; and promote the development of insurance products for identity theft.
