摘要
随着现代业主关注焦点的转移,窗前绿地的归属成为广为关注的焦点,由此而引发的纠纷数量也呈现出显著增长的趋势。窗前绿地上涉及土地所有权、建设用地使用权、植被所有权这三种权利。其中建设用地使用权的归属尤为关键。开发商为实现自身利益最大化与首层房屋购买者设定的"绿地附赠条款"应认定为无效。窗前绿地的建设用地使用权应归小区内全体业主共有,只有业主共同决定才能够对窗前绿地的专有使用权进行配置。
With the transfer of modern owners focus, window green has received more and more attention andfocus, which results a tendency of significant increases in disputes. Windows on the green space relates tothese three rights of ownership: land ownership, land use, and vegetation. Construction land use right ofbelonging is critical. Developers for its own best interest set “green bonus provisions” with first floorhomebuyers should be regarded as invalid. Construction land use right of green land before window should bevested to a total of all owners in the community. Only the owners have right to decide to configure theexclusive window green space, and to achieve effective utilization of window green and minimize disputes thenumber associated with the window green.
