摘要
警察央地分权面临着国家治理体系与治理能力现代化推进的挑战和我国单一制下央地关系不断发展变化的挑战,而现有法律对警察央地分权的规定不足、现行警察体制在央地分权上存在缺陷。厘清国家治理现代化进程中的警察央地分权问题,可以进一步规范央地治理体系、提升治理能力,为解决中央与地方之间利益纠纷、矛盾冲突提供新思路与新方向,有利于促进和保障国家的统一与稳定。应明确警察央地分权的价值目标与原则以及内容与界限等基本问题,并从规范化警察央地分权相关法律依据、建立央地两警分设机制、形成警察央地分权良性的互动机制等方面进行。
The separation of police powers between central and local has been facing the challenging from the modernization of national governance and governance ability, and from the development and change of the relationship between central and local under unitary system in China. There is defect in the separation of police powers between central and local under present Chinese police system, also there is lack of legal provisions in the system. It is the issue that is the separation of police powers between central and local in the modernization of national governance, so this is an issue that need to strive to be understood. Now, we should standard the system of national governance between central and local and promote the governance a- bility, make clear the value view and principles by law.
