The Analysis of the Ownership and Protection Mechanism of the Intellectual Property of University Digital Teaching Resources

摘要 充分利用数字化教学资源并将其引入课堂是"信息技术与教育教学深度融合"的趋势。这种趋势极大地激发了数字化教学资源的原创热情,个中所涉知识产权保护问题已经引起各方主体的关注,相关的法律纠纷时有发生。坚持以"意志说"和"责任说"为评判标准,明确不同资源表现形式的知识产权归属,确定利益相关主体的权利与责任,保护原创,实现利益共享是鼓励原创、促进知识信息高效传播、提高知识信息利用效率的最佳路径。 It has been a trend to deeply integrate information technologies with education to take full advantage of digital teaching resources by introducing it into the class. This trend tremendously motivates the original enthusiasm of digital teaching resources, and the problems therein concerning intellectual prop- erty protection have also drawn public attention while related legal disputes occur occasionally. This paper suggests that we should insist on "the Will Theory" and "the Responsibility Theory " as judging criteria, specify the intellectual property ownership of various forms of resources, define the rights and responsibilities of benefit-related subjects, and protect the originality. To realize the benefit sharing is the best way to encourage originality, to promote the efficient communication of knowledge information, as well as to improve the application efficiency of the knowledge information.
