摘要
"十二五"期间,我国核电产业发展将迎来战略机遇期。日本福岛核灾害后,我国公众对核电产生严重恐惧,内陆省份江西省发生第一起核电争议事件——彭泽核电争议,该事件最终对暂停内陆地区核电发展规划亦产生了一定的影响。在我国核电复兴大背景下,从核电项目风险控制的角度看,公众参与程序的合理引入,不仅可以凭科学依据消除公众疑虑,也可从许可程序中考虑的异议理由中,更完整地收集各界信息,权衡不同法益,以预防对基本权利的侵害。关于核电项目公众参与的制度设计中,应加强核电知识的普及和教育,提高风险沟通能力;公众参与的时间节点应尽可能在最前端;公众参与的透明度应更加强化;公众参与方式需要进行一定的限制。
China' s nuclear power industry is ready for strategic development during the period of the Twelfth Five Year Plan.The Fukushima nuclear disaster in Japan has caused serious fear of nuclear power among the general public in China.The first instance of nuclear dispute occurred over Pengze nuclear power in Jiangxi,one of hinterland provinces.This event has had an impact on the suspension of hinterland nuclear power development plan.Against the background of nuclear power revival in China,in view of the risk control of nuclear power projects,it is necessary to introduce a proper procedure for public participation,which can not only eliminate public concerns by spreading scientific knowledge,but also collect information from the dissenting voices articulated by people from all walks of life in the procedure so as to balance various legal interests and to take precautions against violating basic rights.In designing a system of public participation for nuclear power project,it is important to disseminate the knowledge of nuclear power more effectively,improve risk communication,arrange for public participation as early as possible,enhance the transparency of public participation and also pose limits on the means of public participation.
