摘要
集体建设用地市场化是新型城镇化背景下农村集体建设用地制度变迁的历史过程。集体建设用地市场化存在制度风险,具体包括制度生成的非中性和路径依赖风险、制度运行的内部风险和溢出风险、集体建设用地隐性市场的处置风险。因此,必须明确集体建设用地市场化的法律原则,优化制度变迁路径;健全土地利益机制,保证制度生成中性;设立交易范围、条件、关系、程序法定和交易过程规范的市场交易制度;确立柔性干预、刚性干预和宏观调控三者结合的政府介入制度;建立集体建设用地隐形市场的处置机制,稳步推进集体建设用地市场化改革。
Collective construction land marketization is a historical process during the new urbanization system transforming .System risks exist in the marketization of collective construction land , including sys-tem generated non-neutral and path-dependent risks , internal risks and overflow risks of system running , disposal risks of the invisible market in collective construction land .Therefore ,we should make clear the legal principles and optimize the institutional change path;also we should improve the interest mechanism and make sure to generate a neutral system; establish a standard trading system concerning trading scope , condition , relationship , and legal trading procedure and process; we should establish a govern-ment intervention system that combines flexible intervention , rigid intervention and macro adjustment and control;and set up a disposal mechanism for the invisible land market , steadily promote the reform on collective construction land marketization .
