摘要农村集体经营性建设用地入市,是贯彻党的二十大提出的全面推进乡村振兴的重要战略部署。入市改革是促进农民经营增效、赋予农民更加充分财产权的必要举措。入市改革牵涉多方利益,因此,要将入市工作置于中国农地改革、激活乡村发展活力背景下,在现有政策和法律框架内,将土地管制、土地发展权、农民土地增值权益等立法理念,贯穿在入市改革配套制度的建构中。本文结合全国入市试点地区的工作实践,研究了农村集体经营性建设用地入市的制度支持体系。聚焦农地入市的法律障碍,提出了相关修法和政策建议。 Putting rural collective land for commercial use into the market is an important strategic deployment to comprehensively promote rural revitalization put forward by the 20th National Congress of the Communist Party of China.Market entry reform is a critical measure to promote the efficiency of farmer management and grant them adequate property rights.The reform of entering the market involves multiple interests,so it is necessary to place the work of entering the market in the context of China’s agricultural land reform and rural revitalization.Within the existing policy and legal framework,legislative concepts such as land control,land development rights,and farmers’land value-added rights should be integrated into the construction of the supporting system for the reform of entering the market.Based on the practice of the pilot areas of the country,this paper studies the institutional support system for the market of rural collective commercial construction land.Focusing on the legal obstacles of agricultural land entering the market,this paper makes an empirical study of the work in pilot areas and puts forward some relevant law revision and policy suggestions.
