摘要
进入二十一世纪以来,因为镜像服务引发的诉讼数量占了我国图书馆著作权纠纷案件的绝大部分。本文以一起图书馆镜像服务侵犯著作权纠纷典型案件为视角,探讨了相关的法理、立法和审判中的法律适用问题,阐述了图书馆开展镜像服务应当把握的著作权法律界限。
Since the beginning of the twenty - first century, the number of lawsuits triggered because the mirror services accounted for the vast majority of our library copyright disputes. In this paper, together library mirrored services typical cases of copyright infringement perspective of the application of law in the legal, legislative and trial of the Library mirror service should grasp the copyright laws of boundaries.
