摘要
近年来,运动员的受教育权受到社会的广泛关注,受教育权是运动员职业生涯中最为重要的权利,但在现实生活中,运动员受教育权遭受不法侵害的现象屡见不鲜。文章从法律的视角论述了运动员受教育权的法律保障现状,指出存在的问题:第一,理念认识不足;第二,立法层面非义务教育的主体范围狭窄、法律保障的内容体系不健全、责任机制不完善;第三,司法层面法律的可操作性差、缺乏法律救济。并在此基础上进行了成因分析,有针对性地提出对策建议:应从运动员群体的特殊性出发,加深运动员受教育权理念认识,完善立法、健全司法,切实保障运动员的受教育权。
In recent years, athletes＇ fight to education has gained wide attention. The fight to education is the most important fight in the athletes＇ careers, which is, however, frequently violated in reality, so legal protection of the ath- letes＇ fight to education is necessary. This paper elaborates the current situation of the legal protection of athletes＇ right to education ,and we find the following existing problems： first, there is insufficient understanding of the con- cept ; second, the main scope of the non- compulsory education at the legislative level is narrow, the content of the le- gal safeguard system is not perfect, and the responsibility mechanism is not perfect; third, there lacks feasibility at the judicial level and legal remedy. We also analyze the causes of these problems and come up with corresponding eoun- termeasures and suggestions that we should defend athletes＇ right to education by hess of their fight to education according to the particularity of this group,and by cial system. deepening the athletes＇ conscious- perfecting the legislation and judi-
