摘要
比赛性质和运动情境是决定体育伤害案件判决结果的衡平因素。其一,职业体育伤害与业余体育伤害具有根本差异。职业体育活动作为一种谋求生计的工作,具有更严格的社会责任和注意义务,在案件审理与判断过程中应该予以区分考虑;其二,对"运动情境"因素的考察,避免了从单纯运动技术合规性的角度寻找证据线索和判断依据,可以对致伤情形与事实形成有力的证据链环节的补充,对行为人致伤行为的主观心理和比赛氛围形成进一步的理解,为准确判断致伤情形中行为人运动技术运用的合法性提供依据。建议在今后的体育伤害案件审理过程中,对"比赛性质"和"运动情境"这两个衡平因素进行充分的实证与考量,完成经得起专业审视和历史检验的司法判例。
The two problems,match nature and sports situation the equity factors determining the verdict results,should be considered in sport injury cases. Firstly,there are fundamental differences between professional sport injury and amateur sport injury. For livelihoods,professional sport activity has more rigorous social responsibilities and duties,so it should be separately considered in the process of trial and judgment. Secondly,sport situation should be investigated,avoiding simply searching for clues and evidences from the perspective of sport skills compliance. Also,it is needed to complement evidences which can prove the injury situations and the facts and further understand the practitioners subjective psychology and the match atmosphere of the injury behavior so as to provide evidences to accurately judge the practitioners utilization legitimacy of sport skills in the injury cases. It is recommended to sufficiently examine and consider the two equity factors of match nature and sport situation in future trials of sport injuries to complete judicial precedents withstanding the test of professional and history.
