摘要
研究目的:研究瑞典不动产登记的立法制度、产权体系、登记体制等方面的法律和实践,充分借鉴其先进经验,提出完善中国不动产登记的法律法规制度的对策和建议,从而达到促进不动产产权管理规范化、保障权利人合法利益的目的。研究方法:实地调查法、比较分析法、文献检索法。研究结果:瑞典的不动产登记系统的成功之处在于其完善的法律制度、以不动产单元为基础的产权管理模式和各部门按统一标准在统一的信息系统平台上分工合作共享信息的工作模式。研究结论:中国当前从实践上按《物权法》要求推动不动产统一登记制度的可行途径是:颁布实施《不动产登记法》,完善不动产产权管理的法律体系;引入以不动产单元为管理对象的理念;实行以土地为核心的不动产登记制度;完善不动产统一登记信息系统的法律法规和标准体系。
The purpose of this paper is to systematically review the legislation regime such as tenure structure,registration and other laws and practice in Sweden to put forward solutions and suggestions for the integration of the real property registration system in China.It is meaningful for improving the standardization of tenure administration and guaranteeing the legal right of property owner’s.Methods used include comparative analysis and document summary.The results showed that the legislation institution and administrative model based on property unite,as well as the unified information system platform used by all authorities are the three elements that lead Sweden’s registration system to success.The paper concludes that the feasible approach of achieving the integrated real property registration system in China in accordance with Property Law is as follows.First,to issue the Real Property Registration Law to ameliorate the legislation system of property administrative;second,to introduce the concept of property unit and;third,to establish the unified technical stands of real property registration information system.
