摘要 文创产品是文化产业主体经营的对象,其双重性质决定了文化产业的法律特征。大陆文化产业相关法律的演进具有阶段性,目前已基本形成体系。台湾文创产品进入大陆市场的法律地位低于港澳地区,适用外国法与大陆对台湾特别法,随着两岸关系不断融合,法律环境日益好转。探析大陆文化产业法律及其趋势,对促进台湾文创产品顺利进入大陆市场有重要现实意义。 Cultural and creative products are the main business object of cultural industries.The dual nature of the products determines the legal characteristics of cultural industries.The evolution of the cultural industry goes through several stages,and the system has been basically formed so far.The legal status of Taiwan's cultural and creative products in the mainland market is lower than that of Hong Kong and Macao's,with the application of foreign law and the special law for Taiwan.With the harmony of cross-strait relations,the legal environment is improved.It is practically significant for Taiwan cultural and creative products successfully entering the mainland market to analyze the law of cultural industry as well as the trends of the mainland.
