摘要
近年来由医疗产品缺陷造成患者人身损害的案例明显增加,法律对医疗产品缺陷的规制却并不完善。本文欲在《侵权责任法》的背景下,结合相关法律法规,阐述医疗产品缺陷侵权责任中医疗产品缺陷的概念,希望以衡平的法律价值观为我国司法实践处理医疗产品缺陷损害案件提供一些裨益。
In recent years,because of the medical product defect,the cases about patient personal damage increased significantly.However,the regulations about medical product defect are not perfect.Under the background of Tort Liability Act,combining with the related laws and regulations,the paper presents the concept of medical product defect from the point of view of liability for tort of medical product defect,hoping to providing reference for dealing with the cases about tort of medical product defect with legal value.
