摘要
公案是蕴含着公共性主题元素,为各界广泛参与,其处理结果具有社会导向性的案件。公案的审理受到了民意的影响。为了实现公案的司法公正必须确立相应的评判标准。公案的司法公正评判维度有理论层面、程序层面、历史层面和域外司法实践等四个方面。公案的司法公正对于中国的法治建设具有着重要的时代价值。
There are three characters to describe public cases, the public thematic elements, the various people involved and the social guidance implied. The trails of public cases are affected by public opinions. In order to realize the judicial justice of public cases, the relevant judgment criteria should be established. The judgment criteria of public cases have four dimensions, which are theoretical level, procedural level, historical level and extra - territorial practice level. The judicial justice of public cases has great value in era in China＇ s construction of legal system.
