摘要
分析了哈贝马斯的形式法律范式、福利法律范式,分析了学界提出的几种解决资本主义法治国危机的几种方式,最后分析了程序主义法律范式对于中国意义。
Habermas＇ formal paradigm of law and welfare paradigm of law are analyzed.Several ways to resolve the crisis in capitalist country under the rule of law are analyzed,which are proposed by scholars.The significance of proceduralist paradigm of law for China is analyzed as well.
