摘要
法的合法性来源于理性与信仰,是以现实社会为基础的,其中潜含了人们对法治观念的认可度,为此分析了韦伯与哈贝马斯关于法的合法性所进行的思辨中包含了对“亚里士多德法治公式”的共识及理性与信仰的辩证关系,提出了如何构建对法的合法性研究体系。
The legitimacy of law is rooted in the real society which stemmed from rationality and conviction and latently contained people＇s acceptance for legal concepts. I put forward how to establish the research system of Legitimacy of law through analysing common sense of Webber and Habermas about ＂Aristoteles＇ Legal formula＂ included in deliberation about Legitimacy of law.
