摘要
民族传统体育不仅属于体育,而且也是一种文化现象,具有现行知识产权的特征。目前,我国保护民族传统文化的传承与发展过程中大多采用非物质文化遗产的行政法保护,采用知识产权制度保护民族传统体育也是一个重要途径。采用文献资料、逻辑分析等方法分析了民族传统体育知识产权保护的价值,分析现行知识产权制度保护民族传统体育的可行性与存在的法律冲突,在比较分析非物质文化遗产知识产权的国际保护模式基础上,提出我国民族传统体育的知识产权保护方略。
Nation traditional sports has symbol of intellectual property,it＇s not only belongs to sports but also a cultural phenomenon.By now,we usually use non-material cultural heritage Administrative Law protection during developing our nation traditional culture,it＇s also an important way.With literature and logic analysis to analysis the value of protecting our intellectual property of nation traditional sports culture then analysis the inflict between feasibility of active intellectual property institution protect that and existence law.Based on the national protection mode of non-material cultural heritage intellectual property,here we provide protection resource on our nation traditional sports culture in intellectual property.
