摘要
区域经济一体化的发展对地方政府以行政区域为单位各自为政的行政立法模式提出严峻挑战。针对当前我国跨区域行政立法所存在的法律缺失,借鉴欧盟一体化法制协调和美国州际立法协作的有益经验和具体做法,我国现阶段的跨区域行政立法模式应该是在现有行政区划制度和现行立法体制框架下的中央与地方合理分工、职能协调相结合的立法模式。
The development of regional economic integration has posed severe challenges to the local governments＇ administrative legislation in their own way.Owing to the absence of cross-regional administrative legislation,we should establish a new administrative legislation pattern which has rational division and coordinated function between the central and the local governments in the existing system of administrative divisions and institutional framework of existing legislation.It is better to learn from the experience and practice of the coordination of EU integration law and the collaboration of U.S.interstate legislation.
