摘要
大学生申诉作为一个依靠证据去裁决的行为,证据规则就应当是学生申诉制度设计中的一个核心内容。我国目前在学生申诉证据规则的系统研究上尚属空白。文章从不同裁决行为的证据规则选择入手,探讨了学生申诉证据规则设定的基本思路,论述了学生申诉中的证明责任、证明标准以及证据效力等问题,并简要分析了学生自认和孤证处分等特殊处分的处理。
The complaint of university students as a behavior relied on evidence to rule,the rules of evidence should be a core content in the system design of students complaints.now,the systematical research on the rules of evidence of student complaints is still blank in our country.from differing from rules of evidence of decision behavior,the article probe the basic ideas about the rules of evidence of students complaints,discuss the burden of proof,the standard of proof and the validity of evidence about the complaint of students,and briefly analyze the treatment of some special punishment about students＇ admission,the punishment of single evidence and so on.
