摘要
海峡两岸具体规定的不同,致使两岸在对残骸打捞的规范上存在一定冲突。从海洋法原理出发,运用实证的方法,对残骸打捞的管辖权、责任主体、费用追偿等问题进行分析,提出在台湾海峡残骸打捞管辖权问题上,两岸可实行属人管辖或由最早接到求救请求并赶到救援地点的一方管辖;残骸打捞责任主体按照各自的法律规定确认。台湾地区的有关规定对残骸打捞责任主体确定的范围比大陆的窄,不利于台湾地区的残骸打捞清除,提出打捞费用的追偿可通过从拍卖所得中"优先"受偿、行政执行、提起海事请求或无因管理诉讼等途径向责任主体主张;打捞方既可持本地法院判决书申请对岸法院承认与执行,也可直接向对岸法院提起诉讼。
Different regulations on wreck salvage between Taiwan and the mainland causes conflict of laws in law enforcement.The author,from the perspective of maritime law principles,has applied the empirical methods to research on jurisdiction,subject of liabilities and cost recovery of wreck salvage.After research in how both sides respectively legislate on the above issues,this paper puts forward that,on the issue of wreck salvage jurisdiction,the two sides may reach agreement on the principle of personal jurisdiction be implemented or that it will be administered by the party who first received the request for help and rushed to the rescue site and that the subjects of liabilities will be confirmed according to their respective law.However,Taiwan,compared with the mainland,has a narrower subject of liabilities for wreck salvage,which does do harm to the wreck salvage and removal.Whereas,this paper is also to conclude that the claim for salvage expenses shall be pursued to the concerning parties of liability by means of priority of compensation from the auction,administrative execution,maritime claims or voluntary service lawsuit and that the salvage party,with the local court judgment,may apply to the other court for its recognition and enforcement or directly file an action to the other court.
