摘要
北极的独特自然条件和地理状况决定了它对气候变化的敏感性。作为全球气候变化的预警系统和主要作用地区,北极法律问题在很大程度上已经不是区域性问题,而已上升到全球气候变化公共治理的范畴中。在后哥本哈根时代,北极法律问题,尤其是与生态和环境保护有关的法律问题,例如生物多样性保护、航道利用、渔业资源管理、原住民权利等完全可以纳入到全球气候变化谈判的议题之中,成为全球气候公共治理的关键部分。
The Arctic＇s sensitivity to climate change is due to its unique natural conditions and geographical situation.The Arctic is an early warning system for global climate change,and a main region affected by climate change.Therefore,legal problems of the Arctic have not only been,to a large extent,regional issues,but also included in the public governance of global climate change.In the post-Copenhagen era,legal problems of the Arctic,especially the issues connected with ecological and environmental protection,including the biodiversity conservation,utilization of passage,fishery resource management and aboriginal rights,can be included in the agenda of global climate change talks and become vital parts of public governance of global climate change.
