摘要
发展规划作为一种现代行政管理手段,通过有效合理的手段和方式来达到资源的合理配置,弥补市场的缺陷和不足。目前我国发展规划缺少相应的法律规制,随之产生诸多矛盾和问题,亟待解决。本文通过提出发展规划立法模式之争,介绍分析了德国空间规划法律体系的特点,以期对我国建立健全发展规划法律体系有所借鉴。
As a modem administrative means, plan would satisfy the reasonable allocation of resources by rational means and rescue the defection of the market. At present, China lacks effective legislations on plan and thus bring about many contradictions. This paper introduces different opinions on legislative modes in China on Plan Law, and on the basis of making comments on comparing legislations on space plan of Germany, it sets up the basic structure of Chinese Plan Law in the near future.
